Welcome to SupplyScout. By downloading, accessing, or using the SupplyScout mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully before using our services.

1. Acceptance of Terms

By creating an account or using SupplyScout, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the App.

2. Description of Service

SupplyScout is a community-driven platform that allows users to report and view the availability of supplies (such as water, ice, fuel, food, and other essential items) at retail locations. The App is designed to assist users during emergencies, natural disasters, and other situations where supply availability information may be valuable.

3. User-Generated Content Disclaimer

You acknowledge and agree that:

• Supply availability can change rapidly and reports may become outdated within minutes of submission
• Users may submit inaccurate, incomplete, or false information, whether intentionally or unintentionally
• SupplyScout has no obligation to verify, monitor, or correct user-submitted reports
• You should always verify supply availability in person before making decisions based on App information

4. No Warranties

SupplyScout expressly disclaims all warranties, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the App will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy or reliability of any information obtained through the App
• Warranties that the App will meet your requirements or expectations

5. Limitation of Liability

This includes, without limitation, damages for:

• Loss of profits, goodwill, or data
• Personal injury or property damage resulting from reliance on App information
• Inability to access supplies or services
• Any actions taken or not taken based on information in the App
• Decisions made during emergency situations

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS ($50), WHICHEVER IS GREATER.

6. Assumption of Risk

You expressly acknowledge and agree that your use of the App is at your sole risk. You assume full responsibility for any decisions made based on information obtained through the App, including but not limited to:

• Travel decisions during emergencies or adverse weather conditions
• Purchasing decisions based on reported supply availability
• Any reliance on the timeliness or accuracy of user reports

7. User Responsibilities

When using SupplyScout, you agree to:

• Provide accurate information to the best of your knowledge when submitting reports
• Not submit false, misleading, or malicious information
• Not use the App for any unlawful purpose
• Not attempt to manipulate, hack, or disrupt the App or its services
• Comply with all applicable local, state, and federal laws
• Maintain the security of your account credentials

8. Account Terms

You may create an account using an email address and password, or by signing in with a third-party provider such as Apple or Google. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. If you sign in through a third-party provider, your use is also subject to that provider's terms and policies. SupplyScout reserves the right to suspend or terminate accounts that violate these Terms or engage in fraudulent or abusive behavior.

9. Indemnification

You agree to indemnify, defend, and hold harmless SupplyScout and its owners, officers, directors, employees, agents, licensors, and suppliers from and against all claims, losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from:

• Your violation of these Terms
• Your use of the App
• Any content you submit to the App
• Your violation of any rights of another party

10. Intellectual Property

The App, including its design, features, and content (excluding user-generated content), is owned by SupplyScout and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our express written consent.

11. Premium Subscriptions

Certain features of the App require a paid subscription ("SupplyScout Premium"). Premium features currently include, but are not limited to:

• Supply Alerts — notifications when specific supplies are reported nearby
• Disaster Alerts — real-time notifications about emergencies in your area
• Emergency Preparedness Hub — disaster checklists, important contacts, first-aid guides, and utility shutoff instructions
• SmartScan — AI-powered analysis of nearby supply availability
• Favorite Stores — save stores for quick access

Premium subscriptions are available on a monthly or annual basis and are billed through your chosen payment method. Subscription fees are non-refundable except as required by applicable law. We reserve the right to modify subscription pricing, add, or remove premium features with reasonable notice. Cancellation takes effect at the end of the current billing period, and you will retain premium access until that date.

12. Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to our collection and use of data as described in the Privacy Policy.

13. Modifications to Terms

SupplyScout reserves the right to modify these Terms at any time. We will notify users of material changes through the App or via email. Your continued use of the App after such modifications constitutes your acceptance of the updated Terms.

14. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the App will cease immediately.

15. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of South Carolina, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SupplyScout regarding your use of the App and supersede all prior agreements and understandings.
